Alice’s guest in this episode is Nathanael Kitingan from Macpherson Kelley .
Nathanael Kitingan is the Managing Principal Lawyer of Macpherson Kelley’s Melbourne office. He is a commercial litigator working predominantly in corporate and personal insolvency.
Nathanael regularly acts for insolvency practitioners in various personal and corporate insolvency administrations and is also often engaged by directors, creditors and companies to advise on restructuring, Corporations Act issues and security enforcement. He also runs litigious insolvency proceedings including preference claims, insolvent trading, property recovery actions, practitioner remuneration applications and public examinations.
Nathanael has practiced law since 2006. He holds Bachelors degrees in Science and Law as well as a Masters in Law specialising in commercial litigation. He is an LIV Accredited Specialist in Commercial Litigation and a professional member of ARITA. Nathanael sits on the Litigation Executive of the Law Institute of Victoria and is the current President of the Australia Malaysia Business Council (Victoria).
In this episode Nathanael and Alice discuss Personal Guarantees, which are really a tool in business that is used prolifically, but one that business owners don’t necessarily know too much about.
Of particular note, they look what is a personal guarantee, why business owners would seek to obtain personal guarantees from their customers, what makes a document a personal guarantee, charging clauses, personal guarantees in debt collection, and whether there is a way to be released from a personal guarantee already granted. Nathanael also provides his tip tips in relation to personal guarantees, together with the best piece of Business Wisdom he has ever received.
