The Louisiana Court of Appeal reviewed Shantavious Bailey's convictions for felon in possession of a firearm, illegal possession of a stolen firearm, and aggravated flight. The court reversed Bailey's conviction for illegal possession of a stolen firearm due to insufficient evidence; the only evidence was an officer's NCIC database report, lacking details about the theft. However, the court upheld the other convictions and found Bailey's total sentence (excluding the reversed charge) not constitutionally excessive given his criminal history. A judge dissented, arguing the majority opinion contradicts existing case law permitting convictions based on uncorroborated hearsay if not properly objected to on appeal.
